GENERAL TERMS & CONDITION OF LAQUA FZCO Dubai/UAE – INTERNET LAQUA ME

SCOPE OF THESE GENERAL TERMS & CONDITIONS
These General Terms and Conditions (T&C) rules all actions between the company LAQUA FZCO Dubai/UAE and its customers in the context of their use of the Internet site www.laqua.co. LAQUA, FZCO is the operator of www.laqua.co (stated below as laqua.co). The contracting parties are on one hand the customer and on the other hand LAQUA FZCO, Dubai/UAE.

ACCEPTANCE OF OUR TERMS
By visiting the website laqua.co, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to laqua.co, you agree to be bound by the following Terms and Conditions. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of laqua.co. You understand, agree and acknowledge that these Terms & Conditions constitute a legally binding agreement between you and laqua.co and that your use of laqua.co shall indicate your conclusive acceptance of this agreement.

CHARACTERISTICS OF THE PROPOSED PRODUCTS
Laqua.co offers premium cosmetic products manufacture in Switzerland but they are not included in warranty, except of those from the producer.

DELIVERY
Orders will be handled within 24 hours (Sunday – Thursday except during national holidays), processed and shipped depending on stock availability. The delivery time is usually between 2-5 working days. Inaccurate or incorrect address details for a customer can affect the quality of the delivery. In this case laqua.co rejects any responsibility. Laqua.co takes no responsibility for delays caused by the delivery service. The delivery is carried out exclusively in the most countries in the Middle East. For orders of less than $100 (value of goods, less discounts) are delivery costs being charged. For orders above $100, the delivery is free of charge for the customer. For unclaimed or rejected orders, the customer will be charged a minimum cost of $10 for administrative effort. For the delivery of an external contractor, their general terms and conditions apply. The customer bears the risks of the product. The customer is asked to check the goods after receipt. He informs laqua.co at hello@laqua.co within 48hrs of any defects or damages. All mentioned delivery times are purely informal information. Laqua.ch is not responsible for longer delivery times.

LACK OF PRODUCT AVAILABILITY
LAQUA.CH puts high value on customer needs, satisfaction and the timely execution of orders. However laqua.ch may reject orders and bear no responsibility toward our customers in case a product is temporarily or permanently unavailable. In this case, the amount already paid by the customer shall be refunded for lack of product availability.

PRICES
Unless otherwise indicated, the prices are in AED. For price changes applies the order date. The customer receives after every order a purchase confirmation by e-mail.

PAYEMENT TERMS AND SECURITY
Customers can select between several payments options: credit card (such as Visa, Mastercard), cash on delivery, or payment over the phone. Laqua.ch reserves the right not to offer certain options and other payment solutions.

In the case of transferring personal data, the security of data transmission is guaranteed by XY. This data will be encrypted by a security protocol and SSL (http). The payment has to be made on the purchase order.

PROPRIETARY RIGHTS
You acknowledge and agree that laqua.co may contain proprietary and confidential information including trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties. Laqua.co authorises you to view and make a single copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved.

PROVISION OF SERVICES
You agree and acknowledge that laqua.co is entitled to modify, improve or discontinue any of its services at its sole discretion and without notice to you even if it may result in you being prevented from accessing any information contained in it. Furthermore, you agree and acknowledge that laqua.co is entitled to provide services to you through subsidiaries or affiliated entities.

DATA PROTECTION
Customers can order with or without logging in. He can order without login as a guest and no personal data will be stored. It means that no customer account nor customer profile will be created. Only the data required to ensure a proper delivery will be saved. A proper registration shall contribute to an efficient and simplified order processing. In such a case, the customer acknowledges that his personal data will be stored. Customer data will in any case not be sold to third parties. When a customer deletes his proper customer’s account, the customer data will be deleted from the database.

SUBMITTED CONTENT

When you submit content to laqua.co you simultaneously grant laqua.co an irrevocable, worldwide, royalty free license to publish, display, modify, distribute and syndicate your content worldwide. You confirm and warrant that you have the required authority to grant the above license to laqua.co

ORDERS
With the acceptance of the order by the customer, legally binding contract agreements enter into force. For each order process the customer acknowledges these General Terms and Conditions and agrees to them. Laqua.co reserves the right to refuse an order. Each successful order will be confirmed by e-mail. Each registered customer can see his profile with his previous purchases.

RIGHT OF RETURNS
The product can be returned within 7 working days without specifying a reason (receipt of the goods is critical). For hygiene reasons, products opened or used by the customer, damaged, dirty, or incomplete cannot be returned. The products must be returned in the original package to the following address: LAQUA FZCO, PO Box 300628, Dubai/UAE. The return fees need to be paid by the customer. When the customer returns products, he is entitled to the following:

• Exchange with a new product
• Voucher for his next purchase
• Reimbursement of the amount according to the value of the goods

Laqua.co reserves the right to charge the postage and packaging fees for such a return. If the product arrives at the customer’s in a poor condition and the cause is not due to transportation, the product will be replaced.

PRODUCT RANGE
Our mission is to offer our customer a range of high qualitative beauty products. The quality of these products as well as an excellent service is among our top priorities. The product descriptions are based on the information supplied by the manufacturer. The product range of laqua.co can be adjusted at any time.

TERMINATION OF AGREEMENT
The Terms of this agreement will continue to apply in perpetuity until terminated by either party without notice at any time for any reason. Terms that are to continue in perpetuity shall be unaffected by the termination of this agreement.

DISCLAIMER OF WARRANTIES
You understand and agree that your use of www.laqua.co is entirely at your own risk and that our services are provided “As Is” and “As Available”. www.laqua.co does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of the www.laqua.co website, information, content, materials, or products. This shall include, but not be limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free or that defects in the service will be corrected.

EXTERNAL CONTENT
Laqua.co may include hyperlinks to third-party content, advertising or websites. You acknowledge and agree that www.laqua.co is not responsible for and does not endorse any advertising, products or resource available from such resources or websites.

LIMITATION OF LIABILITY
You understand and agree that laqua.co and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not laqua.co has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of laqua.co is limited to the greatest extent permitted by law.

CHANGES TO THE TERMS
Laqua.co reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted. The continued use of laqua.co after any changes to the Terms will signify your full agreement to them.

JURISDICTION
You expressly understand and agree that in case of any dispute, any legal matter arising from this agreement or related to your use of laqua.co, the exclusive jurisdiction is the court of Dubai, UAE.If the court of law having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.
